Terms and Conditions

These Terms and Conditions govern the use of the website teporingosgames.com (the "Site"), operated by Teporingos Games, with its address in Tlalpan, C.P. 14100, Mexico City, Mexico.

By browsing or using the Site, you accept these terms. If you do not agree with them, please do not use it.

1. Use of the Site

The Site provides information about Teporingos Games and our video games, apps and development services. You may use it freely for personal and informational purposes.

When using the Site, you agree not to:

• Use it for illegal purposes or in ways that harm others.
• Attempt to gain unauthorized access to its systems, servers or restricted areas.
• Introduce viruses, malicious code or anything else that affects how it works.
• Extract content in bulk or by automated means without our permission.
• Impersonate Teporingos Games or anyone else.

We may suspend access to the Site, in whole or in part, for maintenance or for breach of these terms.

2. Intellectual property

The Teporingos Games brand and logo, as well as the video games, characters, art, music, code, text, images and videos published on the Site, are the property of Teporingos Games or their respective owners and are protected by Mexico's Federal Copyright Law, the Federal Law for the Protection of Industrial Property and applicable international treaties.

You may share links to the Site and screenshots of our games for personal, review or promotional purposes, as long as you credit Teporingos Games as the author. Any other use, such as reproducing, modifying, selling or distributing the content, requires our prior written authorization.

Client projects shown in the portfolio, as well as the trade names, trademarks, logos and other distinctive signs that appear in them, are the property of their respective owners, who retain all rights to them. They are displayed solely as examples of our professional work, with their owners’ authorization or under the agreements entered into with them. Their appearance on the Site does not imply sponsorship, endorsement or affiliation of those owners with Teporingos Games beyond the service relationship described in each project.

3. Video games and apps

Our games and apps are distributed through third-party stores such as Google Play, the App Store and itch.io. When you download them, we grant you a personal, non-exclusive, non-transferable license to use them for entertainment or educational purposes. You do not acquire ownership of the software.

You may not decompile, modify, copy or redistribute our products, or use cheats, bots or tools that alter how they work.

Purchases and refunds: purchases within our products are processed by the corresponding store and are governed by its own payment and refund policies. Virtual items or currencies have no value outside the product and cannot be exchanged for money. If you have a problem with a purchase, write to us and we will help you resolve it together with the store.

We may update, modify or stop offering a product or any of its features at any time.

4. Development services

Information about our software, video game, app and interactive installation development services is for informational purposes only and does not constitute a binding offer.

Each project is quoted individually. Quotes are valid for the period stated in them, and the scope, deliverables, timelines, prices, payment terms and ownership of the rights to the work are set out in an accepted quote or in a contract signed by both parties. In case of any difference, that document prevails over these terms.

5. Content you send us

If you send us messages, comments, files or proposals through the Site, you agree that the information is truthful and that you have the right to share it.

We appreciate ideas and suggestions, but we do not accept unsolicited game, story or character proposals, and submitting them creates no obligation of confidentiality, compensation or credit. If you would like to pitch a project to collaborate on, please write to us first so we can agree on the terms.

6. Third-party links and services

The Site may include links to app stores, social networks or client websites. We do not control those sites and are not responsible for their content, availability or privacy policies. We recommend reviewing their terms before using them.

7. Warranties and liability

We strive to keep the Site working properly and its information accurate and up to date, but it is provided "as is". We do not guarantee that it is error-free or available without interruption.

To the extent permitted by law, Teporingos Games will not be liable for damages arising from the use of, or inability to use, the Site, from technical failures beyond our control or from the content of third-party sites. Nothing in these terms limits the rights granted to you by Mexico's Federal Consumer Protection Law.

8. Privacy

The processing of your personal data is governed by our Privacy Notice, which forms part of these terms.

9. Changes, governing law and contact

We may modify these terms at any time. The current version will be the one published on the Site with its update date, and continuing to use the Site after a change means you accept it.

These terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Mexico City, without prejudice to the rights you may exercise as a consumer before the Federal Consumer Protection Agency (PROFECO).
